Deed of Discharge, Release & Indemnity
1.THE PARTICIPANT AGREES TO COMPLY WITH THE FOLLOWING RULES, TERMS AND CONDITIONS
The participant agrees to abide by the rules of Laser Squad at all times when present at the Laser Squad venue.
(a)No projectiles are to be kicked, thrown or otherwise made airborne by participants.
(b)No Participant shall engage in:
a.Skylarking, anti social, reckless or foolish behaviour;
b.Any other behaviour likely to incur injury to themselves or other participants; or employees or agents of Laser Squad; and
c.Any other behaviour which Laser Squad deems to in its absolute discretion to be unacceptable.
(c)Laser Squad may require any Participant engaging in unacceptable or inappropriate behaviour to leave the Laser Squad venue.
(d)Each Participant must remain within the designated boundaries of the Laser Squad venue at all times.
(e)Each Participant will be required to wear the following:
a.Enclosed shoes; and
b.All other safety devices that Laser Squad may require the participant to wear.
(f)Any Participant who is unable or refuses to comply with rule (e) will not be permitted to participate in at the Laser Squad venue.
(g)All Participants must follow the directives of Laser Squad at all times.
(h)Any Participant injured, or observing another participant to be injured, shall immediately notify Laser Squad staff of the incident.
(i)All Participants agree to fully compensate Laser Squad for damage and/or loss to the property of Laser Squad where such damage or loss is attributable to the Participant’s own careless, negligent or intentional actions.
2.RELEASE AND DISCHARGE
The Participant releases, discharges, waives and forever holds harmless Laser Squad from All claims for Any loss sustained by the Participant whether caused by Laser Squad’s negligent act or wilful act or omission, breach of contract, breath of statutory duty or otherwise in connection with Laser Squad.
3.INDEMNITY
The Participant indemnifies Laser Squad against all claims for any loss sustained by the Participant whether caused by Laser Squad’s negligent act or wilful act or omission, breach of contract of statutory duty or otherwise in connection with Laser Squad.
4.WARRANTY AS TO AGE
With the exception of where this Agreement is executed by a parent or legal guardian of the Participant the Participant warrants that he or she is at least eighteen (18) years of age.
5.BAR TO ACTION
The participant agrees that this deed may be pleaded as bar to any action, suit or proceedings taken at any time by the Participant against Laser Squad arising out or as a consequence of Laser Squad or any incidental activities.
6.DEFINITIONS
In this Deed unless inconsistent with the context or subject matter:
“Laser Squad venue” means location at which Laser Squad is being convened.
“Laser Squad” means a business – Desert Fox Investments Pty Ltd (ABN 21 132 192 600) trading as Laser Squad, its agencies, suppliers, distributors, servants, employees, agents, representatives, directors, and officers.
“Participant” means their FULL NAME, ADDRESS, and TELEPHONE as per section one of this form.
“All Claims” means all claims, actions, suits, demands, damages, interest and costs arising out of or as consequence of Laser Squad, including any incidental activity;
“Any Loss” means any loss, damage or injury to person (including the participant) or property including but not limited to:
(a)Any damage or injury occasioned to a participant, howsoever, by:
a.Any logs, trees, branches or any part thereof;
b.Any rocks, falling boulders or stones;
c.Any rivers, creeks, streams, or any other body of water existing at a Laser Squad venue;
d.Any snakes, spider or any other wildlife whatsoever;
e.Other participants or other persons on or near the Laser Squad venue;
f.Any equipment supplied to the participant by Laser Squad; or
g.Otherwise arising out of the participant’s involvement at the Laser Squad venue.
(b)Any damage or injury occasioned to a participant as a result of a participant:
a.Slipping on rocks, boulders, logs, trees, land or any other substance; and/or
b.falling over; and/or
c.colliding with another participant.
Whether caused by negligence, accident, another Participant, flora or fauna, or however otherwise caused.
7.STATEMENT OF UNDERSTANDING
I acknowledge that I have read and understood and agree to the matters set out in this form and that I am of the lawful age and legally competent to give this waiver, release and indemnity.
I acknowledge that the conditions set out in this form are contractual in nature, are intended to have legal effect and are not merely a warning or a recital.
I have signed this form of my own free will, without any representation/inducement by Laser Squad, its agents or employees.
I acknowledge that I have been informed of and understand the nature of the risks involved in participating in the Laser Squad activity.
I acknowledge that Laser Squad has the right to use any images taken at its venue for promotional purposes. *
